01Agreement

By creating an account or using the MakeMyCall.ai website or apps (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

02The Service

MakeMyCall provides an AI assistant that places phone calls to businesses and public services at your request — booking, checking, confirming, asking — and reports back with summaries and transcripts (and audio recordings, if you turn recording on). The assistant identifies itself as calling on your behalf and discloses that it is an AI when asked. It acts on your instructions but exercises conversational judgment on the line; you are responsible for the requests you make.

03Eligibility & your account

• You must be at least 16 years old (or the age of digital consent where you live) and able to form a binding contract.
• You are responsible for your account credentials and for all activity under your account, including seats you share on a family plan.
• Provide accurate information, and keep it current — calls made from wrong details are still your calls.

04Acceptable use

The Service calls businesses and public services only. You agree not to use it to:

• Call personal or residential numbers, emergency services (such as 911/112), or premium-rate numbers.
• Harass, threaten, defraud, or deceive anyone, or have the assistant impersonate you or any real person.
• Make unsolicited marketing, robocall, or spam campaigns, or violate telemarketing and call-recording laws.
• Pursue anything unlawful, or circumvent the Service's safety limits and fair-use protections.
• Resell, scrape, reverse-engineer, or interfere with the Service.

We may refuse, cancel, or end any call that violates these rules, and may suspend or terminate accounts that do.

05Transcripts, recordings & consent

Calls placed by the Service are transcribed for your review. Audio recording is off by default. If you turn recording on, the assistant states at the start of each call that the call may be recorded, and the audio is kept for you alongside the transcript. By requesting a call, you authorize us to place it, transcribe it, record it if you have enabled recording, and share with the called business the details needed to complete your request. Transcripts and recordings are handled as described in the Privacy Policy.

06Plans, billing & cancellation

• Free plan. Includes a limited number of calls per month, no credit card required.
• Paid plans. Billed in advance on a recurring monthly basis until you cancel. Prices are shown at checkout; we will give you advance notice of price changes.
• Cancellation. Cancel anytime in the app; your plan stays active until the end of the current billing period. Except where the law requires otherwise, payments are non-refundable.
• Fair use. "Unlimited" plans are for normal personal use. We may throttle or review accounts whose volume indicates automated or commercial abuse.

07No guarantee of outcomes

The assistant is good, but the world is not always cooperative: lines are busy, businesses close early, the table is gone. We do not guarantee that any call will connect, complete, or achieve the result you asked for. Summaries and transcripts are provided for convenience and may contain transcription errors — verify important details (times, prices, confirmations) before relying on them.

08Your content

You keep ownership of the instructions you give and the information you provide. You grant us a limited license to use them to operate the Service — to place your calls, generate your transcripts and summaries, and store your history. If you send us feedback, we may use it without obligation.

09Our property

The Service — including its software, models, design, and branding — belongs to MakeMyCall, Inc. and its licensors. These terms give you a personal, non-exclusive, non-transferable right to use it; they do not transfer any ownership.

10Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these terms, create risk or legal exposure for us or others, or if we discontinue the Service (with reasonable notice). Sections that by their nature should survive — including 07, 09, 11, 12, and 13 — survive termination.

11Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any call will be completed.

12Limitation of liability

To the maximum extent permitted by law, MakeMyCall, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities — including consequences of missed, failed, or inaccurate calls. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13Indemnification & governing law

You agree to indemnify MakeMyCall, Inc. against claims arising from your misuse of the Service or violation of these terms. These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules; disputes will be resolved in the state or federal courts located in Delaware, unless the law of your home jurisdiction grants you non-waivable rights to another forum.

14Changes to these terms

We may update these terms as the Service evolves. If the changes are material, we will notify you by email or in the app before they take effect; continued use after that means you accept them. The date at the top always reflects the current version.
